Names.Center provides a platform for buying, selling, and auctioning domain names. We act as an intermediary between buyers and sellers, facilitating secure transactions through our platform and partner services.

• Auction platform for premium domains
• Escrow services through Escrow.com
• Domain valuation and consultation
• Transfer assistance and support

3. User Registration

To access certain features of the Service, you must register for an account. When registering:

• You must provide accurate, current, and complete information
• You must be at least 18 years old or of legal age in your jurisdiction
• You are responsible for maintaining the confidentiality of your account
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use

4. Domain Transactions

4.1 Buying Domains

When purchasing a domain through our platform:

• All sales are final unless otherwise stated
• Payment must be completed through approved payment methods
• Domain transfer will begin after payment confirmation
• Transfer times vary by registrar (typically 5-7 days)

4.2 Selling Domains

When listing domains for sale:

• You must own the domain or have authorization to sell it
• Listings must be accurate and not misleading
• You agree to transfer the domain upon successful payment
• Commission fees apply as per our fee schedule

4.3 Auctions

Participation in domain auctions:

• All bids are binding legal obligations
• Winning bidders must complete payment within 72 hours
• Non-payment may result in account suspension
• Reserve prices may apply to certain auctions

5. Payment Terms

We accept various payment methods including:

• Credit/Debit Cards (Visa, MasterCard, American Express)
• PayPal
• Wire Transfer
• Cryptocurrency (Bitcoin, Ethereum) with additional 10% discount

All payments are processed securely through our payment partners. Currency conversion fees may apply for international transactions.

6. Fees and Commissions

Our fee structure:

• Listing Fee: Free for standard listings
• Success Fee: 10% of sale price (minimum $50)
• Premium Listing: $19.99/month for enhanced visibility
• Escrow Fees: As charged by Escrow.com

7. Intellectual Property

Users acknowledge that:

• Domain names may be subject to trademark rights
• Users are responsible for ensuring no infringement occurs
• Names.Center is not liable for trademark disputes
• We comply with DMCA takedown requests

8. Prohibited Activities

Users may not:

• List domains they don't own or have rights to sell
• Engage in fraudulent or deceptive practices
• Manipulate prices or engage in shill bidding
• Violate any applicable laws or regulations
• Use the platform for money laundering
• Harass or abuse other users or staff
• Attempt to circumvent platform fees

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

IN NO EVENT SHALL NAMES.CENTER, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Names.Center and its affiliates from any claims, losses, damages, liabilities, including legal fees, arising from your use of the Service or violation of these Terms.

12. Dispute Resolution

Any disputes arising from these Terms or use of the Service shall be resolved through:

1. Good faith negotiations between parties
2. Mediation if negotiations fail
3. Binding arbitration as a last resort

Arbitration shall be conducted in San Francisco, California under AAA rules.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Service constitutes acceptance of modified Terms.

15. Termination

We may terminate or suspend your account at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.
